Two groups have filed lawsuits against the Town of Babylon in an effort to halt construction of a planned industrial park at Long Island Avenue and Little East Neck Road in Wyandanch.
One lawsuit, filed by petitioner Love K. Foy, raises concerns about the project's environmental and traffic impacts. The filing argues the development could worsen traffic on Little East Neck Road and Colonial Springs Road and alleges the environmental review failed to adequately address potential effects on the nearby Wheatley Heights Groundwater Protection Area.
The lawsuit also cites concerns about stormwater runoff, arguing that increased pavement and development could reduce the site's ability to absorb rainfall. It further contends that the project would clear more than 100 acres of wooded land, disrupting wildlife habitat and removing a natural sound buffer between nearby communities and the Long Island Rail Road.
Additional concerns outlined in the filing include air quality, noise and truck traffic.
A second lawsuit, filed by the Concerned Taxpayers of Wheatley Heights/Dix Hills, challenges the project's potential impacts on neighboring communities and nearby Pinelawn Cemetery.
The group argues the development would worsen traffic conditions on Little East Neck Road, Long Island Avenue and Colonial Springs Road, describing existing roadway conditions as already congested. The lawsuit also raises concerns about increased noise from truck traffic, loading operations, deliveries and garbage collection.
News 12 reached out to the Town of Babylon for comment and is awaiting a response.
